1. These terms
TEN JAM (the “game”) is published by Orelia LLC (“we”, “us”). By downloading, installing or playing it you agree to these Terms of Use. If you do not agree, do not play it — and delete it.
These terms sit alongside our Privacy Policy, and alongside the terms of whichever app store you obtained the game from. Where a store's own rules give you a stronger right, that right applies.
2. Licence
Orelia LLC grants you a personal, non-exclusive, non-transferable, revocable licence to install and play TEN JAM on devices you own or control, for your own personal entertainment. We keep all other rights.
You may not copy, sell, rent, sublicense, modify, translate, decompile, reverse-engineer or create derivative works from the game, extract or reuse its levels, artwork, sounds or code, remove or alter any notice in it, or use it commercially — except where a law in your country expressly says you may, and only to the extent it says so.
All names, logos, artwork, level designs, sounds and code in TEN JAM belong to Orelia LLC or to its licensors and are protected by copyright and trade mark law.
3. Virtual items
Coins, boosters, stars and any other in-game item are virtual items: a limited, revocable licence to use a feature inside the game, and nothing more. They have no real-world value, are not your property, cannot be exchanged for money, goods or anything outside the game, and cannot be transferred to another person or account.
Virtual items are non-refundable except where the law or the app store's own policy requires a refund. We may add, remove, re-price or re-balance virtual items as part of normal game balancing, and we may adjust a balance that was granted in error or obtained by exploiting a bug. Unused virtual items are lost if you delete the game, and we owe you nothing for them.
4. Purchases and billing
Any purchase in TEN JAM is a one-off purchase — there is no subscription. It is processed by Google Play or Apple under their terms, using the payment method already on your account; we never receive or store your payment details. Prices are shown by the store in your local currency before you confirm, and may vary by region or over time.
Refunds are handled by the store under its own policy, so a refund request goes to Google or Apple, not to us — though you are always welcome to email us first and we will help where we can. A one-time unlock stays tied to the store account that bought it; Settings → Restore Purchases in the game restores it on a new device signed in to that same account.
5. Advertising
TEN JAM is free, so it carries advertising. Rewarded ads are optional and opt-in: nothing plays unless you tap to start it. We choose the ad network, not the individual ads, and we are not responsible for the content of third-party advertising or for anything you buy from an advertiser. How ad data is handled, and how to change your ad consent, is set out in the Privacy Policy.
6. Fair play
Play the game as it is meant to be played. Do not exploit bugs, tamper with saved data, use modified clients, emulators or automation tools to gain items or progress, attempt to obtain virtual items without paying where payment is required, or interfere with the game's operation or anyone else's enjoyment of it.
If you do, we may take corrective action — including resetting affected progress or balances, and withdrawing your licence to play.
7. Availability and updates
The game is provided “as is” and “as available”, without warranties of any kind, whether express or implied, including any implied warranty of merchantability, fitness for a particular purpose, or non-infringement. We do not promise that the game will be uninterrupted, error-free, or compatible with every device.
We may update, change, suspend or discontinue the game or any feature, level or item at any time, and we may stop supporting older devices or operating system versions. Updates may be required to keep playing.
8. Limitation of liability
To the maximum extent permitted by law, Orelia LLC is not liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, lost data or lost virtual items, arising out of or in connection with your use of the game. Our total liability to you for all claims is limited to the greater of the amount you paid us in the twelve months before the claim, or ten US dollars.
Some jurisdictions do not allow the exclusion of certain warranties or the limitation of certain damages. Nothing in these terms limits or excludes any liability that cannot lawfully be limited or excluded, and nothing in them affects your statutory consumer rights.
9. Changes to these terms
We may update these terms as the game changes. The effective date at the top will change with it, and anything material will also be noted in the app store listing. Continuing to play after an update means you accept the updated terms; if you do not accept them, delete the game.
10. Governing law
These terms are governed by the laws of the State of New York, USA, without regard to its conflict-of-laws rules, and the state and federal courts located in New York shall have jurisdiction — except where the mandatory law of your country of residence gives you the right to bring a claim, or requires a different law to apply, in which case that right stands.
